Welcome to List'd ("List'd," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the List'd mobile application, website, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

1. Eligibility

You must be at least 13 years old to use the Service.

By using List'd, you represent and warrant that:

  • You are at least 13 years old.

  • You have the legal capacity to enter into these Terms.

  • Your use of the Service complies with applicable laws.

We reserve the right to restrict or terminate access for users who do not satisfy these requirements.

2. User Accounts

You are responsible for:

  • Maintaining the security of your account.

  • Keeping your login credentials confidential.

  • All activity that occurs under your account.

You agree to provide accurate information and keep your account information reasonably current.

We may suspend, restrict, or terminate accounts at our discretion.

3. User Content

"User Content" includes any content you create, upload, submit, post, transmit, or otherwise make available through the Service, including:

  • Images

  • Usernames

  • Profile information

You retain ownership of your User Content.

However, by submitting User Content through the Service, you grant List'd a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to:

  • Use

  • Host

  • Store

  • Cache

  • Display

  • Reproduce

  • Distribute

  • Modify

  • Adapt

  • Analyze

  • Process

  • Promote

such User Content for purposes including:

  • Operating the Service

  • Improving the Service

  • Promoting the Service

  • Developing new features

  • Research and analytics

  • Commercial and business purposes

  • Monetization of the Service

This license survives for a reasonable period after content removal where necessary for backup, legal, operational, or business purposes.

4. Community Standards

You agree not to:

  • Harass, threaten, intimidate, or abuse others.

  • Engage in hate speech or discriminatory conduct.

  • Impersonate another person or entity.

We may remove content, restrict features, suspend accounts, or permanently ban users at our discretion.

5. Direct Messages and Communications

The Service may include messaging and communication features.

Users are solely responsible for the content of communications they send.

We reserve the right to investigate reports involving messages and take appropriate moderation or enforcement action.

Use of messaging features does not guarantee privacy beyond the protections described in our Privacy Policy.

6. Tournaments, Polls, Challenges, and Competitions

The Service may include:

  • Tournaments

  • Polls

  • Challenges

  • Rankings

  • Competitions

  • Badges

  • Awards

  • Achievements

List'd reserves the right to:

  • Create, modify, suspend, or remove competitions.

  • Adjust tournament structures or rules.

  • Correct scoring or voting errors.

  • Remove fraudulent entries.

  • Disqualify users.

  • Revoke awards, badges, rankings, or achievements.

  • Modify eligibility requirements.

All tournament, competition, poll, challenge, and badge decisions are final unless otherwise determined by List'd.

Participation in any competition does not create any entitlement to compensation, prizes, ownership rights, or other benefits unless expressly stated.

7. Data Use and Commercial Activities

You acknowledge and agree that List'd may collect, analyze, process, use, and monetize information generated through use of the Service.

This may include:

  • Rankings

  • Lists

  • Engagement data

  • Behavioral information

  • Preferences

  • Interactions

  • Poll responses

  • Tournament participation

  • Usage statistics

We may use such information for:

  • Advertising

  • Marketing

  • Audience insights

  • Analytics

  • Product development

  • Commercial partnerships

  • Research

  • Business operations

We may also create and use aggregated, anonymized, de-identified, or statistical information derived from Service activity.

8. Intellectual Property

The Service, including its software, design, branding, logos, features, and content provided by List'd, is owned by List'd or its licensors and is protected by applicable intellectual property laws.

Except as expressly authorized, you may not:

  • Copy

  • Reproduce

  • Distribute

  • Reverse engineer

  • Modify

  • Create derivative works from

any part of the Service.

9. Third-Party Services

The Service may rely on third-party providers, including:

  • Cloud hosting providers

  • Advertising partners

We are not responsible for the availability, accuracy, or practices of third-party services.

10. Account Suspension and Termination

  • AVAILABILITY

  • ACCURACY

  • RELIABILITY

We do not guarantee:

  • Continuous service availability

  • Error-free operation

  • Accuracy of user-generated content

  • Permanent preservation of data

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIST'D, ITS AFFILIATES, OWNERS, EMPLOYEES, CONTRACTORS, AND PARTNERS SHALL NOT BE LIABLE FOR:

  • INDIRECT DAMAGES

  • INCIDENTAL DAMAGES

  • CONSEQUENTIAL DAMAGES

  • SPECIAL DAMAGES

  • LOSS OF PROFITS

  • LOSS OF DATA

  • BUSINESS INTERRUPTION

  • USER-GENERATED CONTENT

  • USER CONDUCT

Your use of the Service is at your own risk.

13. Indemnification

You agree to defend, indemnify, and hold harmless List'd and its affiliates, officers, employees, contractors, and partners from any claims, damages, liabilities, losses, costs, and expenses arising from:

  • Your use of the Service

  • Your User Content

  • Your violation of these Terms

  • Your violation of applicable laws

14. Changes to the Service

We reserve the right to modify, suspend, discontinue, or remove any aspect of the Service at any time without liability.

This includes:

  • Features

  • Content

  • Rankings

  • Tournaments

  • Polls

  • Challenges

  • Badges

  • User accounts

15. Changes to These Terms

We may revise these Terms from time to time.

Updated Terms become effective upon posting. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
